POCONO DULCIMER FEST - Performance Rights agreement

 The Pocono Dulcimer Club (a member of the Folk Arts Consortium) has purchased a blanket performance license from BMI and ASCAP for the festival concerts. 

 You agree that your setlist will be limited to:

·         your original songs:

·         Songs represented 100% by BMI, ASCAP, or both:

·         Songs in the public domain; or

·         Songs for which you independently have acquired a written performance license from the copyright holder:

 Each performer must agree that you will not assume a song you intend to perform is fully represented by ASCAP and/or BMI, but that you will search their respective repertoires to confirm.  You may easily do this by visiting this website:  www.Songview.com

 Each performer must provide your setlist to Norm Williams prior to your performance, with evidence of your own due diligence regarding each title you intend to perform.

Here’s a suggested format for each song on your setlist:

1.      Song title:

2.      Song composer:

3.      Public Domain – yes or no: check www.pdinfo.com

4.      Original – yes or no

5.      ASCAP/BMI information (if not original or public domain) : www.Songview.com

Each performer must agree that if a claim be made that you have violated this provision, or any provision herein related to compliance with copyright laws, you will fully indemnify and defend Pocono Dulcimer Festival and its members, and hold them harmless from all costs, expenses, attorney fees, and other fees and losses of whatever kind caused by your alleged violation.

We ask you to do this to protect the integrity of the Pocono Dulcimer Club.
